Terms of Use

1. Parties and scope

The website published on the globya.com.tr and globya.net.tr domains and their subdomains (the "Site") is operated by Globya Bilgi Teknolojileri (Globya Information Technologies; Mustafa Kemal Mh. Dumlupınar Bulvarı, Tepe Prime Plaza A Blok No:266 D:18, Çankaya/Ankara, Türkiye; "Globya"). These Terms of Use apply to everyone who visits the Site or uses its forms, site assistant and free tools (the "User"). By continuing to use the Site, you confirm that you have read and accept these terms; if you do not accept them, please do not use the Site.

Services and products purchased from Globya (corporate websites, IMFLEXI, READERP, custom software, hosting, maintenance, etc.), the customer portal and management panels are governed by the separate contracts and proposals signed between the parties. In case of any conflict between these terms and such contracts, the contract prevails.

2. Nature of the Site content

Information on the Site about products, services, processes, timelines, prices and technical features is for general information only and does not constitute an offer within the meaning of Turkish Code of Obligations No. 6098. Only a written proposal issued by authorized persons and a contract accepted by the parties are binding on Globya. Globya reserves the right to change, update or remove Site content without prior notice.

Projects shown in the references and case studies sections are publicly available work of the respective clients or are shared with their approval; the brands and logos used in these projects belong to their owners.

3. Site assistant (AI)

The replies of the chat assistant on the Site are generated automatically by artificial intelligence and may contain incomplete or incorrect information. Prices, timelines, scope, technical or legal information given by the assistant are not binding; written confirmation from our team should be obtained for definitive information. Please do not write sensitive information such as passwords, card details or health data in the chat. How chat records are processed is explained in the Privacy Notice.

4. Free preliminary analysis and tools

The free preliminary analysis and similar tools on the Site automatically examine the publicly available pages and records of the website entered. The User agrees to enter only websites they own or are authorized to have analyzed. Analysis results are an automated preliminary assessment and are not guaranteed to be complete or error-free. In particular, KVKK (data protection) and security checks are a technical pre-scan and do not replace legal opinion or advice.

5. User obligations

The User agrees to use the Site in accordance with the law and these terms. Accordingly, the User:

• provides their own accurate and up-to-date information in forms, and applies on behalf of someone else only if authorized,
• does not engage in actions that would harm the Site, its servers or other users, create excessive load or circumvent security (automated bulk requests, unauthorized scraping, vulnerability scanning, attack attempts, etc.),
• does not send bulk/unsolicited messages or misleading, insulting or unlawful content through the forms and the site assistant,
• does not attempt to mislead, misuse or disable the assistant or the tools.

In case of breach of these obligations, Globya reserves the right to block the relevant access and to take legal action. If you notice a security vulnerability on the Site, we kindly ask you to report it to info@globya.com.tr without exploiting it.

6. Intellectual and industrial property rights

All text, images, design, software code, databases, logos and trademarks on the Site (Globya, IMFLEXI, READERP and others) belong to Globya or its licensors and are protected under Law No. 5846 on Intellectual and Artistic Works and Industrial Property Law No. 6769. They may not be copied, reproduced, modified, distributed or used commercially without Globya's written permission.

No separate permission is required for: (i) using the files on the Logo kit page to refer to Globya, in line with the usage rules in the kit; (ii) short quotations from Site content with attribution and a link to the relevant page. Third-party products and brands mentioned on the Site (e.g. ERP, payment and marketplace systems) belong to their owners; unless stated otherwise, mentioning them does not imply a partnership or endorsement.

7. Third-party links

The Site may contain links to third-party websites that are not under Globya's control. Globya is not responsible for the content, security or privacy practices of these websites; their own terms apply.

8. Limitation of liability

Globya takes reasonable technical and administrative measures to keep the Site running without interruption, errors or security issues; however, it cannot be held liable for interruptions caused by maintenance, updates, failures of infrastructure providers or force majeure, or for indirect damages arising from the use of information on the Site. This limitation does not apply in cases of Globya's intent or gross negligence, or where mandatory rules of law provide for liability (Turkish Code of Obligations No. 6098, Article 115).

9. Personal data and cookies

Information on personal data processed through the Site is in the Privacy Notice; the cookies we use and how you can change your preferences are in the Cookie Policy. You can exercise your rights under KVKK through the channels on the Data Subject Request page.

10. Changes

Globya may update these Terms of Use when necessary. The current text takes effect on the date it is published on this page; the last update date is shown at the top of the page. Continuing to use the Site after a change means that you accept the current terms.

11. Governing law and jurisdiction

These terms are governed by the laws of the Republic of Türkiye. The Courts and Enforcement Offices of Ankara (Central) have jurisdiction over disputes arising from these terms. The rights of Users acting as consumers under Consumer Protection Law No. 6502, including applying to consumer arbitration committees and consumer courts, are reserved.
